Terms and Conditions of Entry

• The Promoter is Better Pets and Gardens Pty Ltd ABN 77 117 248 405 of 3/673 Marshall Road, Malaga WA 6090.
• Information on how to enter and prizes form part of these Conditions of Entry. Entry into this competition is deemed acceptance of these Conditions of Entry. If you do not accept these terms and conditions, you cannot participate in the competition or be eligible for any prizes offered in the competition. Any entry not complying with the Terms and Conditions is invalid.
• Entry into the promotion is open to Western Australian residents who are aged 18 years and over.
• Employees, suppliers and immediate families of Better Pets and Gardens and agencies associated with this promotion are ineligible to enter.
• Terms and conditions will be published on the BPAG website at https://www.betterpetsandgardens.com.au/terms-conditions/
• The competition commences at the opening of business (Perth time) on Saturday, 5th September 2026 and closes at the close of business on Wednesday, 30 September 2026.

• A person may enter the Competition by purchasing any Squat Club Cat Litter at a participating Better Pets and Gardens store during the promotional period.
• To enter, an eligible customer must scan the QR code on the entry slip provided at the time of purchase and complete the online entry Google Form in full, including the participating store, receipt number, name, phone number and email address. in full, including receipt number, name, phone number, and email.
• All required details must be completed to be valid. Entrants must retain their original purchase receipt and provide it to the Promoter on request.
• Entrants may submit one entry for each eligible transaction. Each entry must relate to a separate valid purchase receipt, and the Promoter may request the receipt as proof of purchase.
• The Promoter accepts no responsibility for late, lost, incorrectly entered or misdirected entries.
• The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these Conditions of Entry.

PRIZE

• Each prize is a $500 Kazoo Cat Scratcher voucher. One prize awarded for each of the six Better Pets and Gardens stores, with a total prize pool valued at $3,000. The voucher can be redeemed against one or multiple Kazoo cat scratchers to the total value of $500.
• Products must be in stock (on the shop floor) at the time of redemption.
• The full prize value must be redeemed in a single transaction.
• The prize, or any unused portion of the prize value, is not exchangeable for cash, credit or other goods or services. Any amount not redeemed as a Kazoo Cat Scratcher will be forfeited.
• The prize must be redeemed in person at the store of entry (where the original qualifying purchase was made), unless otherwise agreed with the Promoter. Photo identification will be required on redemption.
• Each prize must be claimed and redeemed by 31/10/26. If a prize is not claimed and redeemed by that date, it may be forfeited and dealt with in accordance with the unclaimed-prize provisions below.

THE DRAW

• All valid entries submitted through the Google Form will be automatically recorded in the corresponding response spreadsheet. At 10:00 am (Perth time) on 1 October 2026, the draw will be conducted electronically at the Promoter’s premises at 3/673 Marshall Road, Malaga WA 6090. One winner for each participating Better Pets and Gardens store will be selected at random using an electronic random-selection method from the valid entries allocated to that store.
• The draw will be conducted electronically and will not be open for public attendance.
• No further correspondence or negotiation will be entered into.
• Each winner will be contacted by phone or email using the details provided in the online entry form within two business days of the draw. The winners’ names and localities may also be published on the Better Pets and Gardens website or other advertising platforms.

SUSPENSION/TERMINATION

• If for any reason this Competition is not capable of running as planned, including but not limited to technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, we reserve the right in our sole discretion to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Competition.
• If the Prize is unclaimed because a Prize-winner cannot be contacted within 15 business days following the Draw Date or if the Promoter determines that the Prize-winner is not eligible to participate in the Promotion, the Prize may, at the Promoter’s sole discretion, be forfeited and redrawn. The Promoter is not responsible if the Prize-winner cannot be contacted within 15 business days after the Draw Date.
• Any redraw will be conducted electronically at the Promoter’s premises at 3/673 Marshall Road, Malaga WA 6090 on a date and at a time determined by the Promoter. Any replacement winner will be notified by phone or email within two business days of the redraw and may be announced on the Better Pets and Gardens website or other advertising platforms.

DATA PROTECTION

• Each participant acknowledges and agrees that, if selected as a winner, the Promoter may use their name, image and/or voice, including photographs, film or recordings, in any media for the purposes of conducting and promoting the competition and Better Pets and Gardens. The Promoter will use entrants’ personal information to administer the competition and award the prizes. Entrants will receive future marketing communications only where they have separately consented to receive them and may opt out at any time by following the unsubscribe instructions in a communication or contacting the Promoter directly.
• All entries remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and, where appropriate, award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion.
• Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant lottery legislation. All personal information will be stored at the office of the Promoter.
• You acknowledge and agree that we will handle and use your personal information in accordance with our Privacy Policy as set out on our website at https://www.betterpetsandgardens.com.au/about-us/policies/website-privacy-policy/. A request to access, update or correct any information should be directed to us.
• Google is not a sponsor of, and is not responsible for administering, this competition. Entrants’ information will be submitted through Google Forms and recorded in a Google response spreadsheet for the purpose of administering the competition.

LIMITATION OF LIABILITY

• The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any website or telecommunication systems, or any other reasons outside of our control.
• Except for any liability that cannot be excluded by Australian law, we and our officers, employees and agents exclude all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following:
  • the arrangement for the supply, or the supply, of goods or services by any person to the Prize winners and, where applicable, to any persons accompanying the Prize winners;
  • any theft, unauthorised access or third-party interference;
  • any prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by us) due to any reason beyond our reasonable control;
  • any variation in prize value to that stated in these terms and conditions;
  • any tax liability incurred by a winner or entrant.
  • participation in the Competition; and/or
  • redemption and/or use of a Prize.
• To the fullest extent permitted by law, any liability of us or our officers, employees or agents for breach of any such rights is limited to the payment of the costs of having the Prize supplied again.
• Where the competition is promoted through a social media platform, each participant releases that platform and its associated companies from liability arising in connection with the promotion and acknowledges that:
  • The promotion is in no way sponsored, endorsed or administered by, or associated with any social media platform.
  • Any information provided by the participant in connection with the Promotion is provided to the Promoter and not to any social media platform; and
  • any questions, comments or complaints regarding the Promotion will be directed to the Promoter, not to any social media platform.
