Terms and Conditions of Entry

• The Promoter is Better Pets and Gardens Pty Ltd ABN 77 117 248 405 of 3/673 Marshall Road, Malaga WA 6090.
• Information on how to enter and prizes form part of these Conditions of Entry. Entry into this competition is deemed acceptance of these Conditions of Entry. If you do not accept these terms and conditions, you cannot participate in the competition or be eligible for any prizes offered in the competition. Any entry not complying with the Terms and Conditions is invalid.
• Entry into the promotion is open to Western Australian residents who are aged 18 years and over.
• Employees, suppliers and immediate families of Better Pets and Gardens and agencies associated with this promotion are ineligible to enter.
• Terms and conditions will be published on the BPAG website at https://www.betterpetsandgardens.com.au/terms-conditions/
• Each monthly competition commences at 12.00am (midnight) Perth time on the first calendar day of the month and closes at 11.59pm (Perth time) on the last calendar day of that month.

HOW TO ENTER

• A person may enter the Competition by commenting on the official Better Pets and Gardens Pet of the Month competition post on Facebook or Instagram during the relevant monthly promotional period.
• The comment must include one photo of the entrant’s pet and the pet’s name.
• Only entries submitted as a comment on the official competition post during the relevant monthly promotional period will be accepted.
• Entrants must own the pet shown in the submitted photograph or have the pet owner’s permission to enter, and must have permission to submit and use the photograph.
• Each pet may be entered once per monthly competition. The same photograph may be entered again in a future monthly competition period.
• The Promoter accepts no responsibility for late, lost, incorrectly entered, deleted or misdirected entries, or entries not visible to the Promoter due to social media privacy settings or technical issues.
• The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these Conditions of Entry.

PRIZE

• There is one (1) Pet of the Month prize to be won each month. The prize and its value may vary from month to month and will be stated in the official Better Pets and Gardens Pet of the Month competition post for that month.
• If the Prize or any part of the Prize is unavailable for any reason, the Promoter, in its sole discretion, reserves the right to substitute the Prize, or any component of it, with a prize of equal or greater value and/or specification.
• The prize or any unused portion of the prize is not exchangeable for other goods or services and cannot be taken as cash. If the prize is transferred, it is subject to the transferee being bound by these terms and conditions as they apply to the entrant of the promotion themselves.
• The prize must be collected in person from Better Pets and Gardens Head Office, 3/673 Marshall Road, Malaga WA 6090, unless otherwise agreed with the Promoter. Photo identification will be required on pickup.

THE DRAW

• The monthly draw will take place on the first Tuesday of the following month at Better Pets and Gardens Head Office, 3/673 Marshall Road, Malaga WA 6090. The winner will be selected at random from all valid entries received during the relevant monthly promotional period.
• No further correspondence or negotiation will be entered into.
• The winner will be contacted via direct message and/or a reply to the winning competition comment within 15 business days of the draw and may be announced on the Better Pets and Gardens website, social media channels or other advertising platforms.

SUSPENSION/TERMINATION

• If for any reason this Competition is not capable of running as planned, including but not limited to technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, we reserve the right in our sole discretion to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Competition.
• If the Prize is unclaimed because a Prize-winner cannot be contacted within 15 business days following the relevant monthly draw, or if the Promoter determines that the Prize-winner is not eligible to participate in the Promotion, the Prize may, at the Promoter’s sole discretion, be forfeited and redrawn. The Promoter is not responsible if the Prize-winner cannot be contacted within 15 business days after the relevant monthly draw.

DATA PROTECTION

• Each participant acknowledges and agrees that, in the event they are drawn as the winner, the Promoter may use their name, submitted pet photograph and competition entry content in any media for the purposes of conducting the promotion and promoting Better Pets and Gardens. Any personal information supplied by entrants may be used for the purposes of administering the competition and contacting the winner.
• All entries remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and, where appropriate, award prizes. If personal information reasonably required to administer the promotion is not provided, the entrant may not be able to participate in the promotion or receive a prize.
• Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant lottery legislation. All personal information will be stored at the office of the Promoter.
• You acknowledge and agree that we will handle and use your personal information in accordance with our Privacy Policy as set out on our website at https://www.betterpetsandgardens.com.au/about-us/policies/website-privacy-policy/. A request to access, update or correct any information should be directed to us.

LIMITATION OF LIABILITY

• The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, social media platform, or failure of any comment, message or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet, at any website or telecommunication system, or for any other reasons outside of our control.
• Except for any liability that cannot be excluded by Australian law, we and our officers, employees and agents exclude all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following:
  • the arrangement for the supply, or the supply, of goods or services by any person to the Prize winners and, where applicable, to any persons accompanying the Prize winners;
  • any theft, unauthorised access or third-party interference;
  • any prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by us) due to any reason beyond our reasonable control;
  • any variation in prize value to that stated in these terms and conditions;
  • any tax liability incurred by a winner or entrant.
  • participation in the Competition; and/or
  • redemption and/or use of a Prize.
• To the fullest extent permitted by law, any liability of us or our officers, employees or agents for breach of any such rights is limited to the payment of the costs of having the Prize supplied again.
• The participant releases the social media platform(s) and its/their associated companies from all liability arising in respect of the promotion and acknowledges that:
  • The promotion is in no way sponsored, endorsed or administered by, or associated with any social media platform.
  • Any information provided by the participant in connection with the Promotion is provided to the Promoter and not to any social media platform; and
  • any questions, comments or complaints regarding the Promotion will be directed to the Promoter, not to any social media platform.
