Terms and Conditions of Entry

• The Promoter is Better Pets and Gardens Pty Ltd ABN 77 117 248 405 of 3/673 Marshall Road, Malaga WA 6090.
• Information on how to enter and prizes form part of these Conditions of Entry. Entry into this competition is deemed acceptance of these Conditions of Entry. If you do not accept these terms and conditions, you cannot participate in the competition or be eligible for any prizes offered in the competition. Any entry not complying with the Terms and Conditions is invalid.
• Entry into the promotion is open to Western Australian residents who are aged 18 years and over.
• Employees, suppliers and immediate families of Better Pets and Gardens and agencies associated with this promotion are ineligible to enter.
• Terms and conditions will be published on the BPAG website at https://www.betterpetsandgardens.com.au/terms-conditions/
• The competition commences 8.00am (Perth time) on Tuesday, 9 September 2025, to close of business on Monday, 29 September 2025.

HOW TO ENTER

• A person may enter the Competition by scanning the QR code on the front cover of the Better Pets and Gardens Spring 2025 catalogue, which will take them to an online form to enter their name, email address, phone number, and postal address and select yes or no to the question: ‘I would like to receive special offers and updates from Better Pets and Gardens’ and selecting submit.
• All details must be entered for the entry to be valid and submitted.
• The Promoter accepts no responsibility for late, lost, incorrectly entered or misdirected entries.
• The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these Conditions of Entry.

PRIZE

• There is one prize of $1000 for the Better Pets and Gardens group.
• The $1000 prize will be paid via electronic funds transfer to the winner’s nominated Australian bank account within two weeks of receiving the winner’s banking details.

THE DRAW

• The draw will take place by random digital selection using a fair and independent process at 10 am on Tuesday, 30 September 2025, at Better Pets and Gardens Head Office – 3/673 Marshall Road, Malaga, WA 6090.
• No further correspondence or negotiation will be entered into.
• The winner will be contacted by phone or email provided on the entry form within 15 business days of the draw and may be announced on the BPAG website or other advertising platforms.

SUSPENSION/TERMINATION

• If for any reason this Competition is not capable of running as planned, including but not limited to technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, we reserve the right in our sole discretion to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Competition.
• If the Prize is unclaimed because a Prize-winner cannot be contacted within 15 business days following the Draw Date or if the Promoter determines that the Prize-winner is not eligible to participate in the Promotion, the Prize may, at the Promoter’s sole discretion, be forfeited and redrawn. The Promoter is not responsible if the Prize-winner cannot be contacted within 15 business days after the Draw Date.

DATA PROTECTION

• Each participant acknowledges and agrees that, in the event they are drawn as the winner, the Promoter may use their name, image, and/or voice (including photograph, film, or recording) in any media for the purposes of conducting the promotion and promoting Better Pets and Gardens. By providing their details, entrants also consent to the Promoter using the information supplied for the purposes of administering the competition and for future marketing communications, unless they opt out. Entrants may opt out of marketing at any time by following the unsubscribe instructions provided in communications or by contacting the Promoter directly.
• All entries remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion.
• Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant lottery legislation. All personal information will be stored at the office of the Promoter.
• You acknowledge and agree that we will handle and use your personal information in accordance with our Privacy Policy as set out on our website at https://www.betterpetsandgardens.com.au/about-us/policies/website-privacy-policy/. A request to access, update or correct any information should be directed to us.

LIMITATION OF LIABILITY

• The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any website or telecommunication systems, or any other reasons outside of our control.
• Except for any liability that cannot be excluded by Australian law, we and our officers, employees and agents exclude all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following:
  • the arrangement for the supply, or the supply, of goods or services by any person to the Prize winners and, where applicable to any persons accompanying the Prize winners;
  • any theft, unauthorised access or third-party interference;
  • any prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by us) due to any reason beyond our reasonable control;
  • any variation in prize value to that stated in these terms and conditions;
  • any tax liability incurred by a winner or entrant;
  • participation in the Competition; and/or
  • redemption and/or use of a Prize.
• To the fullest extent permitted by law, any liability of us or our officers, employees or agents for breach of any such rights is limited to the payment of the costs of having the Prize supplied again.
• The participant releases the social media platform(s) and its/their associated companies from all liability arising in respect of the promotion and acknowledges that:
  • the promotion is in no way sponsored, endorsed or administered by, or associated with any social media platform.
  • Any information provided by the participant in connection with the Promotion is provided to the Promoter and not to any social media platform; and
  • any questions, comments or complaints regarding the Promotion will be directed to the Promoter, not to any social media platform.
